These Terms & Conditions ("Terms") govern your access to and use of the website located at arkaproductions.in (the "Site"), operated by Arka Productions ("Arka", "we", "us", "our"), and any inquiries, engagements, or services arising from your use of the Site. By accessing the Site or submitting an inquiry through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Arka Productions is a creative and video production studio offering services including, but not limited to, video production and content creation, creative strategy and brand growth, post-production and editing, design and brand identity, web and digital presence, and event and on-ground production.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You must not attempt to gain unauthorized access to any part of the Site, its systems, or any related network, or introduce viruses, malware, or other harmful material.
All content on this Site — including but not limited to text, graphics, logos, the Arka name and branding, images, videos, and design elements — is the property of Arka Productions or its licensors and is protected by applicable intellectual property laws. Portfolio work showcased on the Site may include content produced for clients and is displayed with permission or under a portfolio-use right retained by Arka. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
Ownership and usage rights for deliverables produced under a specific client engagement are governed separately by the applicable project agreement, quotation, or statement of work between Arka Productions and the client, which takes precedence over this Site's general Terms for matters of that engagement.
When you submit an inquiry through the Site (for example, via the "Start a Project" form), you agree to provide accurate and current information. Submitting an inquiry does not create a binding contract, project engagement, or obligation on either party. A formal engagement begins only once both parties agree to and sign a separate proposal, quotation, or contract outlining scope, timelines, and payment terms.
Pricing, deliverables, timelines, revisions, and payment terms for any commissioned project are set out in the relevant project agreement or invoice issued directly to the client, and are not governed by this Site. Any estimates, packages, or figures referenced informally on the Site or in marketing communications are indicative only and subject to change.
The Site may contain links to third-party websites or platforms, including social media. We do not control and are not responsible for the content, privacy practices, or availability of any linked third-party sites. Accessing them is at your own risk.
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Arka Productions shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of, or inability to use, the Site. Our total liability arising from your use of the Site shall not exceed the amount, if any, paid by you to us in connection with the Site in the twelve (12) months preceding the claim.
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts having competent jurisdiction.
We may update these Terms from time to time to reflect changes to our services or for legal or operational reasons. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
